Pending means a program is law but not paying yet. Voluntary means you're covered only if your employer buys a policy or, in New Hampshire and Vermont, joins an opt-in state plan. "Own recovery, max" is the legal limit for your own health condition, usually much longer than a typical birth recovery. The weekly maximum is a ceiling, not a typical benefit. Job protection often comes from a different law than the pay (for example in California, Connecticut, DC, New York and Rhode Island); each state page explains. Amounts usually change January 1 and July 1, so confirm with your state before you plan. 26 states have no program.

The federal baseline
The federal Family and Medical Leave Act (FMLA) gives eligible workers up to 12 weeks of unpaid, job-protected leave in a 12-month period for a birth and to care for the newborn, or for their own serious health condition, including pregnancy complications and recovery from childbirth. Health coverage continues during leave, and you return to the same or an equivalent job.

The Pregnant Workers Fairness Act requires employers with 15 or more employees to provide reasonable accommodations for limitations related to pregnancy, childbirth or related conditions unless it causes undue hardship. EEOC lists leave for health care appointments and leave to recover from childbirth as examples. It doesn't require the leave to be paid.
No federal law requires private employers to give paid family, maternity or parental leave. FMLA leave is unpaid, though workers can use paid leave they've earned, and the Fair Labor Standards Act doesn't require pay for time not worked.

Federal civilian employees covered by title 5 FMLA can get up to 12 weeks of paid parental leave for each birth or adoption/foster placement on or after Oct. 1, 2020, used within 12 months after the birth or placement. It requires 12 months of qualifying federal service and is separate from sick and annual leave.
Among paying states, the most you can get per week in 2026 ranges from $900 (DE) to $1,765 (CA) for family leave; New York's disability benefit for pregnancy recovery is capped at $170 a week.

The federal employer tax credit for paid family and medical leave (IRC section 45S) was made permanent by the One Big Beautiful Bill Act, enacted July 4, 2025. It rewards employers that offer paid leave voluntarily; it doesn't give workers a right to leave.

Which states have paid family leave?
As of October 2026, California, Colorado, Connecticut, Delaware, District of Columbia, Maine, Massachusetts, Minnesota, New Jersey, New York, Oregon, Rhode Island and Washington pay family and medical leave benefits. Maryland (from January 2028) and Virginia (from December 2028) have passed programs that start paying later. Alabama, Arkansas, Florida, Kentucky, Louisiana, New Hampshire, South Carolina, Tennessee, Texas and Vermont have voluntary programs or let insurers sell family leave coverage to employers. Hawaii pays disability benefits for pregnancy and childbirth but not paid bonding leave.
What if my state has no paid leave?
No federal law requires private employers to give paid family, maternity or parental leave. In 13 of the 13 paying programs, yes, in two parts: paid time to recover from pregnancy and birth, and paid time to bond with your baby. The table shows bonding weeks and the legal maximum for your own recovery; each state page has the typical weeks for a birth.

We built this in October 2026. For every state with a paid family and medical leave law, we read the state program's own website (benefit amounts, how many weeks, who qualifies, job protection and how to apply) and the law itself, and compared them with the National Partnership for Women & Families' April 2026 chart and a February 2026 benefits-industry summary. Where they disagree, we use the state's own information and explain the difference in the state's notes.
For voluntary programs we read each state's law. For states with no program, we used national trackers updated through July 2026, checked 2025 and 2026 bills in many legislatures directly, and read each state's laws on unpaid pregnancy and parental leave. 'Paying' means benefits are paid now; 'enacted' means the law passed but benefits start later; 'voluntary' means an opt-in state plan or a law that lets insurers sell family leave coverage to employers.
Bonding weeks are paid weeks to bond with a new child. Pregnancy recovery weeks are the legal maximum for your own pregnancy- or childbirth-related health condition; the usual amount is often shorter, so we also give the agency's typical guidance. The weekly maximum is a ceiling, and most people get less. Several states changed their maximum in mid-2026 (Rhode Island, Oregon, Colorado and Maine in summer, DC on October 1), and most reset on January 1, 2027, so check with your state program before you plan around a number.
